1. Definitions
In these conditions the therapist means Lorna Scott a qualified, registered and insured Occupational Therapist. Client means person(s), firm or company by whom the instruction for occupational therapy services is given or is the planned or actual recipient of occupational therapy services. The person(s), firm or company giving the instruction may be different to the planned recipient or actual recipient. Bill payer means the person(s), firm or company who has agreed to pay any invoice sent by the therapist and may or may not be the same as the recipient of Occupational Therapy (OT)services. Occupational Therapy (OT) Services means services that are deemed as part of the role of an occupational therapist by the Royal College of Occupational Therapists. Session(s) means any and all investment of time made by the therapist, agreed between the client and therapist for occupational therapy services which may be face- to-face or none face-to-face.
2. Contract introduction
2.1 The therapist confirming the booking of an appointment (verbal/written) constitutes a contract between the therapist and the client at which point these terms and conditions apply.
3. Services
3.1 Requests from the client for OT services may be subject to a triage information gathering process which may include personal information and shall not form part of the contract to supply services.
3.2 All information is handled and stored in accordance with the UK Data protection Act and GDPR.
3.3 Where an instruction is placed by a client different to the recipient of OT services consent to triage and receive OT services will be assumed until such time this can be clarified directly with the intended recipient of OT services.
3.4 Costs and session content will be outlined and agreed with the client in advance of the session(s)
occurring.
3.5 Confirmation of the appointment date, time and cost will be provided by the therapist on a written form.
3.6 Appointements will be booked individually.
3.7 OT services contain reassessment and therefore the plan or recommendations may change.
3.8 The client has the right to decline OT services offered.
3.9 Provision of OT services does not guarantee any specific outcome.
3.10. On occasions, additional charged OT services are required over and above the original agreement. This will be discussed and agreed with the client
prior to completion.
3.11.On occasions, the session duration may be an estimate only. This will be discussed and agreed with the client prior to the session being
completed.
3.12. On occasions, the agreed session is not fulfilled within the agreed length of time in which case suitable financial
adjustment will be invoiced
or time adjustment made in subsequent sessions.
4. Payment & Non-payment
4.1 Where the client is the bill payer and also the recipient of OT services payment in full pounds sterling is required at the time of each face-to-face session by card. This includes face-to-face sessions where the therapist has arrived, but the session not completed either due to consent being removed or pertaining to conditions outlined in clause 5.3
4.2 Where the bill payer is different to the recipient of OT services payment in full pounds sterling for OT services will be invoiced at any time by email to and paid by the bill payer in full pounds sterling by bank transfer, before or on the pay by date and using the bank details specified on the invoice.
4.3 Payment for none face-to-face sessions will be invoiced at any time by email to and paid by the bill payer in full pounds sterling by bank transfer, before or on the pay by date and using the bank details specified on the invoice.
4.4 Divisibility clause – this contract is divisible. The work performed during each session in the currency of the contract will be paid separately. Each payment for any session shall be payable by the bill payer in full accordance with the terms and conditions of payment with in. An example of this would be: payment in full pounds sterling at the time for a face-to-face session, and separately payment in full pounds sterling once invoiced for completion of an agreed associated report.
4.5 Not withstanding the other provisions in these sales conditions, the therapist shall retain ownership and title to the products not paid for in full pounds sterling at the designated time until the client has made full and final payment in pounds sterling (including interest, costs and penalties) that it owes to the therapist under all agreements entered into.
4.6 Failure to pay in full pounds sterling by the invoiced pay by date using the bank details provided or at the time of face-to-face session will result in additional interest, cost or penalties being applied from the first day after the final payment date.
4.7 Failure to pay by the designated date will result in legal proceedings.
5. Cancellations/ discontinuation of appointments
5.1 Appointments cancelled by the client with more than 48 hours’ notice will not be charged.
5.2 Appointments cancelled by the client with less than 48 hours’ notice be charged at the agreed rate for the duration of this
session not including travel.
5.3 Sessions will be charged at the agreed rate of the whole session including travel where the session cannot be completed for the following reasons:
o Client declined after therapist arrival.
o The client is in a state unable to engage in the planned sessione.g.,intoxicated/is
minding children/unwell.
o The client is unavailable e.g.,has gone out.
6. Ending therapy
6.1 There is no obligation for either therapist or client to continue therapy, including where more than one session has been agreed ahead of time of provision of OT services.
6.2 Two consecutive cancellations or sessions not completed for reasons such as stipulated in 5.2 or 5.3 will result in termination of contract & cessation of any outstanding work.
6.3 The therapist is not under any obligation to find a replacement therapist in any event.
6.4 In the event of services ending outstanding payment of OT services completed before the end date of services will be invoiced by email and must be paid by bank transfer in full pounds sterling before or on the pay by date and using the bank details provided on the invoice.
7.
Communication
7.1 Phone, text or email may be used as means of communication.
7.2 Appointments will be confirmed by either text or email.
7.3 If the client does not receive an acknowledgement of their communication, particularly regarding cancellation or request to
rearrange an appointment it must be presumed the therapist has not received the communication, in which case these terms and conditions apply.
8. Emergency procedures
8.1 The client must make the therapist aware of any current DNACPR/ReSPECT document. This must be shown to the therapist at the first face-to face session.
8.2 The therapist will follow the conditions in an original, signed and dated DNACPR/ReSPECT document complete with signatories’ registration number once viewed.
8.3 Emergency services maybe called without the clients consent if the life or safety of the client, therapist or others are at risk.
9.Responsibility & limitation of liability
9.1 It is the clients’ responsibility to read and understand or ask the therapist for clarification to reach understanding
of these terms and conditions.
9.2 It is the clients’ responsibility to provide all relevant information, ensure this information is correct and keep the
therapist up to date with any new or changes to information before and during the course of OT services provision.
9.3 The therapist is not responsible or accountable for any issues arising as a result of insufficient, incorrect supply of, or failure to disclose information.
9.4 The therapist has a responsibility for providing a true and factual account of the clients’ functional level and needs at the time of assessment according to the therapist’s professional opinion. The therapist will, where agreed to, provide a written documentation of the client’s functional level and needs at the time of assessment as per the therapist’s professional opinion, whether or not the client is in agreement with these findings.
9.5 The therapist shall be under no liability whatsoever in the event the client adapts, alters or applies recommendations differently to recommended whether intentionally or unintentionally.
